14 CFR 61.129(a)(4) requires 10 hours of solo flight time in a single-engine airplane or 10 hours of flight time performing the duties of pilot in command in a single-engine airplane with an authorized instructor on board. The time must be entered into the ForeFlight logbook correctly for it to be included on the Commercial ASEL Report.
If the flight is flown solo, without an instructor on board, the pilot must enter the time as solo and the flight conditions as appropriate, i.e., cross country, night, etc. Time can also be logged as PIC, provided the pilot is rated in the category and class being flown.
If performing the duties of pilot in command with an instructor on board, the time will be entered as PIC. The instructor on board is not providing instruction, so do not add dual time. Doing so will result in the time not being included in the Commercial ASEL Report. The Instructor must be added to the Crew & Passengers section as an instructor; otherwise, the flight won't be included.
For more information about the FAA's requirements for logging solo time versus PIC time with an Authorized Instructor on board, as per CFR 61.129(a)(4), review these two interpretation letters:
NOTE: The requirements for logging time and how it is entered in ForeFlight Logbook are to ensure compliance with FAA regulation 61.129 and the legal interpretations and are not separate ForeFlight requirements. It also ensures the time is included in the Commercial ASEL Report.
